AMATEUR ATHLETIC WAIVER AND RELEASE OF LIABILITY
READ BEFORE SIGNING
Oyster Point Dragons
Term: 01/01/2024 – 12/31/2024
In consideration for being allowed to participate in any way in this sport activity, related events and activities, including activities related to dragon boats, outrigger-canoes, canoes, kayaks, paddle boards, and other vessels, or land training equipment, the undersigned acknowledges, appreciates, and agrees that:
The risk of injury or illness from the activities involved in this sport and program is significant, including the potential for permanent paralysis and death, and while particular safety rules, equipment, and personal discipline may reduce this risk, the risk of serious injury or illness does exist; and
I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation; and I willingly agree to comply with the stated and customary terms and conditions for participation, including my agreement to comply with OPD’s Code of Conduct. I also confirm that I will only participate in club activities while in good health, and that I do not have any medical conditions that would pose a serious risk to myself or others while participating. I will not consume any mind altering drugs or alcohol prior to, or during, any team sport events, which may impede my ability to participate thereby putting myself or others at risk. If I have a disability or any constraints, I will inform the coaches, captains, and/or officials so they can optimize my participation.
If however, I observe any unusual or significant hazard or feel ill during my presence or participation, I will remove myself from participation and immediately bring such to the attention of the nearest official; and
I for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless United States Dragon Boat Federation, Oyster Point Dragons, San Mateo County Harbor District, City of South San Francisco, and their respective board members, officers, directors, coaches, steerers, volunteers, officials, agents, and/or employees, other participants, municipalities, sponsoring agencies, commissions, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct events and activities (“Releasees”), with respect to any and all injury, illness, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise. I agree, for myself and all my heirs, not to sue Releasees, not to initiate to assist the prosecution of any claim for damages or cause of action which I or my heirs may have by reason of personal injury, illness, or death to participation or destruction to participants’ property arising from Releasees’ activities.
I also acknowledge that photographs and videos may be taken of me in my participation in, and attendance at, any club activities and events, and hereby freely agree to allow without restriction, all uses of such photos and videos in the reporting of activities and events, and/or in the promotion of these activities and events.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND THE TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

By entering my name below, I consent to conduct business electronically with Oyster Point Dragons. I have read this Release of Liability and Assumption of Risk Agreement, fully understand and agree to its terms, and sign it freely and voluntarily without any inducement. I also agree to comply with Oyster Point Dragons’ Code of Conduct as posted on its website.
By entering my name below, I am effectively providing electronic consent, acknowledgement, and signature.
Consent, Acknowledgement, and Signature – Parent or Guardian certification for participants of minority age (under age 18 at the time of registration):
By entering my name below, I consent to conduct business electronically with Oyster Point Dragons.
I also hereby provide parental or guardian consent to Oyster Point Dragons for the collection of information such as the minor’s name, address, phone number, email address, and emergency contact information as listed above, for purposes of this waiver. We also agree to comply with Oyster Point Dragons’ Code of Conduct as posted on its website.
This is to certify that I, as parent/guardian with legal responsibility for this participant, have read and agree to the terms of this waiver, and hereby do consent and agree to his/her/their release as provided above, of all the Releasees, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, even if arising from the negligence of the Releasees, to the fullest extent permitted by law. I further agree to the covenant not to sue and to the photographic and video release set forth above.
